Further Expansion of the Family and Divorce Filing Digital Service (FDS) to Family Law Actions and Mandatory Filing of a Notice to Attend Family Docket Court Effective August 1, 2023

 

We are pleased to announce further expansion of the Family and Divorce Filing Digital Service to Family Law actions in the judicial centres of Edmonton and Calgary.

As of May 24, 2023, a Notice to Attend Family Docket Court may now be submitted in the Family and Divorce Filing Digital Service.

Effective August 1, 2023, use of the Family and Divorce Filing Digital Service will be mandatory for counsel filing a Notice to Attend Family Docket Court in the judicial centres of Edmonton and Calgary. A grace period of two weeks shall be observed, until August 15, 2023, after which use of Family and Divorce Filing Digital Service for filing a Notice to Attend Family Docket Court will be strictly enforced. 

Please note that Family and Divorce Filing Digital Service cannot accommodate filings for which payment is waived (i.e. fee waiver or Legal Aid Certificate, filings by Alberta Justice), for amended documents, urgent filing requests, applications, and certain orders, these filings will continue to be accepted via Email Filing. 

Family and Divorce Filing Digital Service is available to lawyers (and legal assistants) and law firms only. This announcement does not apply to filings made by self-represented litigants or agencies.

Further Expansion of the Family and Divorce Filing Digital Service (FDS) and Mandatory Filing of Desk Divorce Packages Effective August 1, 2023 

 

Effective August 1, 2023, use of the Family and Divorce Filing Digital Service will be mandatory for counsel filing any Desk Divorce Packages in all judicial centres. A grace period of two weeks shall be observed, until August 15, 2023, after which use of Family and Divorce Filing Digital Service for filing Desk Divorce Packages will be strictly enforced. 

The Family and Divorce Filing Digital Service allows lawyers and legal assistants to file Desk Divorce Packages not requiring fee waivers (Legal Aid Certificates, filings by Alberta Justice), amended documents, urgent filing, chambers applications, certain orders, as these filings will continue to be accepted via Email Filing. 

Family and Divorce Filing Digital Service is available to lawyers (and legal assistants) and law firms only. This announcement does not apply to filings made by self-represented litigants or agencies.
